The Evolving Landscape of Domicile: Impact of Globalization and Emerging Legal Systems
As globalization dismantles traditional borders and emerging legal systems rise, our understanding of domicile in private international law wobbles. This lecture dives into this evolving landscape, exploring how increased mobility, digital nomads, and new legal frameworks challenge the classic "facto" and "animus" tests. We'll analyse and examine inconsistencies across legal systems, and ponder the impact on crucial issues like jurisdiction and domicile.
