Navigating Commercial Disputes: Traditional vs. Modern Resolution Methods in African and the European Legal Systems
The lecture aims to delve into the complexities of resolving commercial disputes within the frameworks of African and European legal systems. The discourse will juxtapose traditional dispute resolution mechanisms, deeply rooted in cultural and customary practices, against modern methodologies employed in both regions. Exploring indigenous methods such as mediation, arbitration and customary law prevalent in various African jurisdictions and highlights the strengths and limitations of these mechanisms in addressing commercial disputes within African contexts. It then contrasts the transmigration of European Dispute Resolution into Africa and its implications for the resolution of commercial disputes.
Rachel Haizel is a lecturer at the University of Ghana School of Law, where she shares her expertise in torts law, Investment Treaty Law, and Alternative Dispute
Resolution with aspiring legal minds. Her academic pursuits align closely with her professional endeavors as a barrister and solicitor of the Supreme Court of Ghana, specializing in commercial law, international investment, transactions, conflict of laws, and corporate matters. She specializes in commercial dispute resolution in both litigation and through Alternative Dispute Resolution.
