Hot off the press: the latest English-language issue of "Gdansk Legal Studies" (4/2022)

We are pleased to announce that the latest issue of "Gdańsk Legal Studies" has been published. Volume under the scientific supervision of Assoc. Prof. Marcin M. Wiszowaty, entirely in English, is devoted to the issues of Innovation in Constitutional Law.

The idea of the volume explained by its scientific editor was to show various examples of innovations in contemporary Constitutional Law. The subject of scientific articles that made up the presented issue of the journal are innovations of various scale and scope - global, regional and local, implemented successfully or ended in failure, as well as remaining in the sphere of future projects.

Thanks to the fact that among the authors there are representatives of foreign research centers from almost all continents, it was possible to present the issue of innovation from a global perspective - as an issue present all over the world.

The number opens with the paper entitled "Transnational Network Authority and the Question of Grounding" by prof. Oren Perez from the Faculty of Law of Bar-Ilan University in Israel.

The African continent is represented by Dr. Roxan Laubscher (University of Johannesburg, South Africa), author of the article entitled "Recognition of Language Rights in South Africa: Innovation or Dismal Failure?".

Representatives of South America, five researchers from the University of Chile - Alexander Núñez Nova, Jose Ledesma Romero, Nicolás Yáñez Viveros, Camilo Aguilera Ramírez, Benjamín Núñez Ochoa - presented in the journal the results of their research on the issue of "Innovations of the Constituent Convention in Chile: The Perspective From Public Participation and Environmental Rights".

The Asian Far East is represented by a team of four researchers from the Faculty of Law of Airlangga University (Indonesia) - Dri Utari Christina Rachmawati, Ekawestri Prajwalita Widiati, Zendy Wulan Ayu Widhi Prameswari, authors of the article entitled "Formal Constitutional Review of the Legislative Process: An Obvious Accommodation or an Innovation for Democracy?".

The honor of representing the European continent fell to two researchers from Italy. Prof. Luca Castelli from the Universita di Perugia presented an article entitled "Downsizing the Parliament in Italy: A Missed Constitutional Amendment and Façade Innovation". Dr. Piero Gambale, an expert of the Italian Chamber of Deputies, is the author of the study entitled "The Environment and its Protection as Fundamental Principle of the Italian Constitution: A Constitutional Innovation that Looks to Future Generations?"

In the commentary section, one will find three very interesting studies by Polish experts - professors of Constitutional Law. Prof. Dorota Lis-Staranowicz (University of Warmia and Mazury, Olsztyn) is the author of the paper entitled "The Admissibility of the Detention of Minors in Guarded Centers for Refugees in the Context of the Principle of Best Interests of the Child". Prof. Piotr Radziewicz (Warsaw University of Technology) - presented a paper on "Diffuse Constitutional Review in the Light of Poland's Constitutional Court Crisis". Prof. Jacek Zaleśny (University of Warsaw) is the author of the commentary entitled "Judicial Legislation as a Form of Appropriation of Competences Not Conferred upon the EU and the CJEU".
