Brief summary:
Criminal liability in the age of artificial intelligence raises complex legal challenges, as AI systems act autonomously without human intent or men area. Poland and the European Union adopt a preventive, regulatory-first approach through frameworks like the EU AI Act, while India relies on adapting existing laws such as the Penal Code and IT Act. Both systems grapple with assigning responsibility when AI causes harm, debating models like programmer liability, corporate accountability, strict liability, or even electronic personhood. The central challenge is balancing accountability with innovation while reimagining criminal law for an AI-driven future. Shipra Gupta is the CEO and Founder of Kanoon Junction and a Ph.D. Research Scholar at Mahindra University, Hyderabad, India.
Her research explores evolving challenges in criminal law, digital governance, and human rights. She has several notable publications, including Male Rape: A Story of Silent Victim in the „International Journal of Law Management and Humanities" and Rape Culture in India: Challenges and Way Forwards, published in the book reviewed by former Chief Justice Dipak Misra and edited by Justice A.K. Sikri and N.K. Chakraborty.
Her work Prohibition of Child Marriage (Amendment) Bill 2021: An Analytical Study appeared in the „Indian Journal of Law and Legal Research". She has also presented at national legal conferences.
Through her academic and professional work, she seeks to bridge doctrinal legal research with pressing contemporary issues in law, justice, and digital society.
